1.3 Membership. The User need not be a member of The Tailings Network to access the Site. However, members are entitled to receive discounts when purchasing Wares and Services from the Site. 2. System Integrity & User Conduct

2.1 You must not use the Site to:

Members are bound by the Tailings Network Code of Ethics which applies in all professional situations including communications through social media channels.

5.1 You expressly acknowledge and agree that the discussion forums on this Site provide a means of public, not private, communication.

5.2 The Tailings Network will not be liable for any information displayed on such discussion forums, whether offensive to persons or group of persons, upsetting, defamatory, in any way unsuitable for people under the age of 18 years, or otherwise, or for the accuracy of such information.

6. Online Store and Financial Transactions

6.1 The Site may allow you to purchase different types of products online (the Wares and Services) that are provided by The Tailings Network. When ordering Wares and Services on the Site, you must provide complete and accurate personal information consisting of your name, address, telephone number, e-mail address, credit card information and shipping address, as well as any other information requested.

6.2 When you provide credit card information, you warrant that you are fully entitled to use that card and that it has sufficient funds to cover any purchases.

6.3 When you make payment on the items in your shopping cart, The Tailings Network or The Tailings Network’ nominee will process the payment against your credit card payment instruction details.

6.4 A printable invoice will be sent via e-mail acknowledging payment once the payment has been processed.

6.5 Any purchases made via this website will be processed by Bank West and will be subject to their usual terms and conditions for such commerce.

7.1 This Site may contain links to third party websites. Those sites are not under the control of The Tailings Network and The Tailings Network is not responsible for the content or the links contained in those sites. Neither The Tailings Network nor its officers, directors, employees, agents, or related bodies corporate recommend or endorse the content of any third party sites which may be linked to or from the Site, or products or services of any third party organisations mentioned or described on this Site or linked to or from this Site. You acknowledge that you enter any third party websites at your own risk.

7.2 The Site may contain advertisements for third parties’ goods and/or services. The third party advertisers are responsible for the accuracy of all representations made in those advertisements. Neither The Tailings Network nor its officers, directors, employees, agents or related bodies corporate recommend or endorse the goods or services that may be advertised on the Site, nor do they offer the goods or services for sale or make any other representation whatsoever about them. 9. Indemnification

11.2 The Tailings Network shall not be liable by reason of the failure in the performance of obligations under the Terms and Conditions by reason of strikes, riots, fire, explosion, acts of God, governmental action, or any other cause which is beyond the reasonable control of The Tailings Network, including any form of technological failure or the actions of third parties.

11.3 These Terms and Conditions constitute the entire agreement between you and The Tailings Network with respect to this Site, and the Terms and Conditions replace all prior or contemporaneous understandings or agreements, written or oral, regarding the Site.

11.4 If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible and will be deemed deleted to the extent that it is nor enforceable, and the remaining provisions of the Terms and Conditions shall remain in full force and effect.

11.5 The failure by The Tailings Network to insist upon or enforce strict performance of any of these Terms and Conditions will not be construed as a waiver of any right or remedy of The Tailings Network  in respect of any existing or subsequent breach of these Terms and Conditions.
